www.yourluxuryescape.co.uk (the “Site”) is produced, owned and maintained by Luxury Devon Escapes Limited t/a Your Luxury Escape (“We”, “Us”).
Please read the booking form carefully as you must agree to the booking terms and conditions before you make a booking.
Property owners give permission for Luxury Devon Escapes Limited to accept reservations for accommodation on their behalf, on the following conditions:
The contract of hire is between the hirer (guest) and the property owner.
The contract of hire is deemed to have been made once a deposit or the total amount of the holiday (at the time of booking) has been paid and confirmation of that booking has been acknowledged by Luxury Devon Escapes Limited to the guest.
Once the deposit is paid you will be liable for the whole rental. It is therefore recommended that any booking to be protected by holiday cancellation and curtailment insurance you must make arrangements to insure against the possible cancellation of your holiday as all cancellations for whatever reason are chargeable. You must make your own arrangements for your insurance.
If a deposit has been paid, the outstanding balance payment is due 8 weeks before the holiday commences. If the balance is not received by the agreed date on the booking confirmation, Luxury Devon Escapes, at their own discretion, reserves the right to re-advertise the property and make the property available for re-booking. Bookings can be secured using a debit or credit card or via BACS.
Check in time on the first day of the holiday and check out time on the last day of the holiday is specific to each property. Only the guest and members of the guests’ party shown on the booking confirmation are permitted to occupy the property for holiday purposes according to the licence of the owner. The property description indicates the maximum number of persons permitted to occupy a property. This must not be exceeded unless by prior written agreement with Luxury Devon Escapes and extra charges may be applicable. Owners reserve the right to refuse admittance if this condition is not observed.
Luxury Devon Escapes and the owners reserve the right to revoke or refuse either prior to or during the stay any booking that they deem unsuitable for the property. Neighbours and the environment must be given due respect at all times. Large group bookings must be discussed with Luxury Devon Escapes prior to booking and may only be accepted by special arrangement.
Use of the property is at your own risk. You must take extra care, especially the supervision of children, in properties where there are steep gardens and steps, swimming pools and ponds, balconies and terraced areas. You are responsible to ensure the property suits your own needs, if you have any special requirements please advise Luxury Devon Escapes before booking.
Pets are only permitted where the property description indicates acceptance of pets. Guests may only bring pets that are mentioned in the booking arrangement confirmation. All pets must be house trained, up to date with flea treatment, well behaved, kept on a lead at all times and never left unattended in a property, unless by prior arrangement with the owner. Pets are not permitted in any bedrooms or on any furniture within the holiday property. Luxury Devon Escapes and the owners do not accept any responsibility for their safety. Where a property description indicates ‘no pets’, this may not guarantee the property has never been occupied by pets.
Luxury Devon Escapes charges a £25 administration fee at the time of booking to cover all administrative tasks associated with the booking procedure.
Throughout the period of occupation, the guest is expected to keep the property clean and in good order, take care of the property and its contents and will be responsible for any breakages or damages. Guests are expected to treat the property with respect, leaving the property and its contents in a clean and tidy condition. This includes the correct disposal of rubbish and waste for recycling and (if applicable) removal and disposal of dog mess.
Luxury Devon Escapes or the owner shall be allowed the right of entry at all reasonable times for inspection, repair or maintenance purposes save for in the case of an emergency when immediate access may be required.
All properties are non-smoking, and smoking shall be prohibited at all times.
Luxury Devon Escapes reserve the right on behalf of the owner to charge a minimum £50 damage sewaiver, payable to Luxury Devon Escapes. This deposit will be refunded to the guest 14 days after departure. A deduction will be made for any breakages or damages done to the property or if the property is not left clean and tidy and in good order, including correct rubbish/ waste disposal, dog mess removal or any other incurred expenses. The damage waiver is accepted by Luxury Devon Escapes on behalf of the owner, not as agents and Luxury Devon Escapes will not act as arbitrator between owner and guest in any dispute regarding the damage waiver. Any dispute will be dealt with directly with the owner and Luxury Devon Escapes cannot accept any responsibility.
Luxury Devon Escapes carefully inspects all properties but cannot accept responsibility for any changes made to the property by the owner following initial inspection. In the unlikely event of a complaint, guests should contact Luxury Devon Escapes immediately where every attempt will be made to resolve the complaint amicably. Disputes will be between the guest and the owner and Devon Luxury Escapes shall not be liable for any claims by the guest or property owner. After guests have departed the property, no complaints can be considered.
Luxury Devon Escapes nor property owners will be liable to any guests for any injury, loss or damage to their property or person, however caused. On departure of the property, guests should ensure that all personal property is removed. If personal belongings are found after departure, Luxury Devon Escapes will be prepared to return these items for a £10 minimum charge for postage and packaging and this must be paid in advance by the guest. No responsibility will be accepted by Luxury Devon Escapes for the safe transit of these items.
In the unlikely event that a property becomes unavailable after booking, Luxury Devon Escapes reserves the right, on behalf of the owner, to cancel any bookings already made. Guests will be offered alternative accommodation, or a full refund of all monies paid.
Once a booking has been confirmed by Luxury Devon Escapes, it can only be changed by cancelling the original booking. A £50 re-booking charge will be payable.
If a booking is cancelled, no refund will be issued unless it meets one of the following criteria and documentation is provided.
A named member of the party is summoned for jury service during the holiday.
A named member of the party is ill or has an injury which means they are unable to travel since the time of booking. No refund will be issued if an injury is sustained due to leisure activity.
A named member of the party suffers a bereavement, up to one calendar month before the start date. (To include spouse, parent, in-law, sibling, grandparent or child but excludes pets).
A full refund minus the booking fee and deposit will be issued if one of the criteria is met. If none of the criteria are met, no refund will be issued.
If the property is rebooked in place of the cancelled booking, a full refund will be issued minus the booking fee, deposit and a £50 administration fee and any discounts applied by Luxury Devon Escapes to achieve a replacement booking. Any additional refunds should be dealt with by your own cancellation insurance provider.
Luxury Devon Escapes cannot accept liability or responsibility for an alterations, delay or cancellation or any other loss or damage caused by war, civil war, terrorism, industrial disputes, fire, bad weather, sickness, livestock, epidemics, acts of any government or public authority, changes imposed by rescheduling airlines, ferries or any event outside of our control.
Property descriptions on our website and in our brochures are believed to be correct and given in good faith but cannot be guaranteed. Luxury Devon Escapes cannot be held responsible for any perceived inadequacies in any of its properties.
Luxury Devon Escapes reserve the right to amend any property details and prices quoted on the website. In the unlikely event of this happening, guests will be notified immediately and will be given the option to cancel their provisional booking.
Luxury Devon Escapes nor the owner can be held responsible for any 3rd party breakdowns, malfunctions or cuts of utility services, however, where possible, every attempt will be made to remedy the problem. Television or telecommunication breakdowns are not the responsibility of Luxury Devon Escapes nor the owner. Normal operation is expected of all these services for guests’ enjoyment however, rural areas can be subject to infrequent interruptions. Relocation or refunds will not be considered for telecommunications or television.
In the unlikely event of a complaint, Luxury Devon Escapes reserves the right to refer it to arbitration under the auspices of the English Association of Self Catering Operators (EASCO).
In the event of any dispute between the third parties it shall be referred to the jurisdiction of the English Courts only and any action shall be heard in court for the area in which the property is situated. Any contract shall be governed by English Law and interpretation.
Luxury Devon Escapes own all property photographs and property descriptions and cannot be used without prior written authority of Luxury Devon Escapes.
These booking temrs and conditions replace all previous conditions.
When choosing a property, you may find that in some instances you are redirected to one of our partner companies in order to finalise your booking and pay. In such cases, you will be bound by the booking terms and conditions of the partner company rather than Luxury Devon Escapes, and we recommend that you make yourself aware any such terms before completing your transaction.
